1. Overview

These Terms of Service govern your use of seventus-3.myshopify.com and any purchases made through our store. By accessing or purchasing from Seventus, you agree to be bound by these terms. These terms constitute the entire agreement between you and Seventus regarding your use of our store and supersede any prior communications, representations, or agreements.

2. Products & Orders

All Seventus products are made to order through third-party fulfillment partners. We reserve the right to refuse or cancel any order at our discretion, including in cases of suspected fraud or pricing errors. Order confirmation does not guarantee fulfillment if an item becomes unavailable.

3. Pricing & Payment

All prices are listed in USD. We reserve the right to update pricing at any time without prior notice. Payment is due in full at the time of purchase.

4. Personalized & Custom Orders

Orders involving customer-requested customizations (such as names, monograms, or design modifications) are final sale once production has begun. Please review all customization details carefully before submitting your order.

5. Intellectual Property

All designs, graphics, artwork, and visual content featured on Seventus are the original creative work of Seventus and are protected under applicable intellectual property laws. You may not reproduce, copy, distribute, or use any Seventus design for commercial or personal purposes without express written permission. Purchasing a product grants you ownership of the physical item only — not the underlying design or any associated rights.

6. Returns & Refunds

All return and refund requests are handled in accordance with our Return & Refund Policy, which is incorporated into these terms by reference.

7. Shipping & Delivery

Estimated delivery times are provided as a courtesy and are not guaranteed. Seventus is not responsible for delays caused by fulfillment partners, carriers, or customs. Risk of loss passes to the customer upon handoff to the carrier.

8. Disclaimer of Warranties

All products and services are provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement. Seventus does not warrant that the store will be uninterrupted, error-free, or free of viruses or other harmful components.

9. Limitation of Liability

Seventus shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our store or products. Our total liability in any matter is limited to the amount paid for the order in question.

10. Indemnification

You agree to indemnify, defend, and hold harmless Seventus and its owners, partners, and fulfillment providers from and against any claims, liabilities, damages, losses, or expenses — including reasonable legal fees — arising out of or in any way connected with your access to or use of our store, your violation of these terms, or your infringement of any third-party rights.

11. Termination

We reserve the right to terminate or suspend your access to our store at any time, without notice, for conduct that we believe violates these Terms of Service or is harmful to other customers, us, or third parties, or for any other reason at our sole discretion.

12. Force Majeure

Seventus shall not be held liable for any failure or delay in performance arising out of causes beyond our reasonable control, including but not limited to acts of God, natural disasters, supply chain disruptions, carrier delays, labor disputes, government actions, pandemics, or failures of third-party fulfillment partners. In such events, we will make reasonable efforts to communicate delays and fulfill orders as soon as practicable.

13. Dispute Resolution

In the event of any dispute arising from or relating to these Terms of Service or your use of our store, both parties agree to first attempt resolution through good-faith negotiation. If negotiation fails, disputes shall be submitted to binding arbitration in the State of Georgia under the rules of the American Arbitration Association, before resorting to litigation. Each party shall bear their own arbitration costs unless otherwise determined by the arbitrator.

14. Class Action Waiver

You agree that any dispute resolution proceedings will be conducted on an individual basis only. You waive any right to bring or participate in a class action lawsuit, class-wide arbitration, or any other representative proceeding against Seventus.

15. Third-Party Links

Our store may contain links to third-party websites or services, including those of our fulfillment partners. These links are provided for convenience only. Seventus has no control over and assumes no responsibility for the content, privacy policies, or practices of any third-party sites. We encourage you to review the terms and privacy policies of any third-party sites you visit.

16. User-Generated Content

If you submit reviews, feedback, photos, or any other content to our store or associated platforms, you grant Seventus a non-exclusive, royalty-free, perpetual license to use, display, and reproduce that content for any business purpose. You represent that you own or have the right to submit such content and that it does not violate any third-party rights.

17. Waiver

Our failure to enforce any right or provision of these Terms of Service shall not constitute a waiver of that right or provision. Any waiver must be made in writing and signed by an authorized representative of Seventus to be effective.

These Terms of Service, together with our Privacy Policy and Return & Refund Policy, constitute the entire agreement between you and Seventus regarding your use of our store and supersede all prior or contemporaneous communications, whether written or oral.

21. Governing Law

These Terms of Service are governed by the laws of the State of Georgia, United States. Any disputes not resolved through arbitration shall be brought exclusively in the courts of Georgia.

22. Changes to Terms

We reserve the right to update these terms at any time. Continued use of our store following any changes constitutes acceptance of the revised terms.
