Seventus operates seventus.co, our customer account services, and the related content, features, products, tools, and services offered through them collectively, the “Services.”

This Privacy Policy explains how Seventus collects, uses, discloses, retains, and otherwise processes personal information when you:

  • Visit or interact with the Services;

  • Create or use a customer account;

  • Make or attempt to make a purchase;

  • Request a personalized product;

  • Contact us through Live Chat or email;

  • Submit a cancellation, return, refund, shipping, or product claim; or

  • Otherwise interact with Seventus.

Seventus is based in Georgia, United States, and is the controller of personal information for the processing activities described in this policy, except where another party—such as Shopify—acts as an independent controller for its own services.

Shopify provides the ecommerce platform that powers the Services. Additional service providers help us process payments, produce made-to-order products, personalize products, deliver orders, prevent fraud, provide customer support, analyze store performance, and advertise our Services.

If this Privacy Policy conflicts with our Terms of Service regarding the collection, use, or disclosure of personal information, this Privacy Policy controls.

2. Personal Information We Collect

“Personal information” or “personal data” means information that identifies, relates to, describes, or can reasonably be associated with an individual or household. It does not include information that has been lawfully anonymized or de-identified.

Depending on how you interact with the Services, we may collect the following categories of personal information.

Contact and Identity Information

This may include:

  • Name;

  • Email address;

  • Telephone number;

  • Billing address;

  • Shipping address;

  • Recipient name; and

  • Other contact information you provide.

Order and Transaction Information

Payment Information

Payment information may include your selected payment method, billing details, payment confirmation, and transaction identifiers.

Complete payment-card credentials are ordinarily processed by Shopify and its payment providers rather than stored directly by Seventus. Their handling of payment information is governed by their own privacy and security practices.

Customer Account Information

This may include:

  • Email address and customer profile;

  • Account preferences and settings;

  • Order history;

  • Authentication and session information; and

  • Information associated with return, cancellation, or account requests.

Personalization Information

When you purchase a personalized or customized product, we may collect the text, name, date, photograph, image, design instruction, message, or other content you submit.

This information may be disclosed to the production partner responsible for creating the product. Do not include sensitive personal information in personalization fields unless it is reasonably necessary for the requested product.

Shipping, Customs, and Recipient Information

Some international destinations or carriers require additional information, which may include:

  • Recipient telephone number;

  • Full legal name;

  • National identification number;

  • Tax identification number;

  • Personal Customs Clearance Code; or

  • Other information required by customs or the carrier.

We use this information only as reasonably necessary to fulfill the order, complete customs clearance, comply with law, prevent fraud, or resolve a delivery problem. We do not use destination-specific identification or tax numbers for targeted advertising.

Customer Support and Claims Information

When you contact us or submit a product or delivery claim, we may collect:

  • Your messages and correspondence;

  • Order number and affected products;

  • Photographs or videos of products;

  • Photographs of packaging and shipping labels;

  • Measurements or other evidence of a defect;

  • Delivery information;

  • The requested resolution; and

  • Records of our response and the outcome of the claim.

Please do not send unnecessary financial, medical, government-identification, or other highly sensitive information through Live Chat or ordinary email.

Device and Technical Information

  • Advertising identifiers;

  • Approximate location derived from an IP address; and

3. How We Collect Personal Information

  • Directly from you, including through checkout, customer accounts, personalization fields, Live Chat, email, privacy requests, claims, and other communications;

  • Automatically, through cookies, pixels, local storage, analytics tools, server logs, and similar technologies;

  • From Shopify, payment providers, customer-account services, and other ecommerce tools;

  • From production and fulfillment partners, carriers, customs intermediaries, and delivery providers;

  • From fraud-prevention, security, analytics, marketing, or advertising partners; and

  • From other parties at your direction, such as when another person places an order for you or you interact with a third-party login, social-media, or payment service.

If you provide personal information about another person, such as a gift recipient, you are responsible for having the authority to provide that information for the order.

4. How We Use Personal Information

We may use personal information for the following purposes.

Providing the Services and Fulfilling Orders

We use personal information to:

  • Operate the store and customer accounts;

  • Process payments and transactions;

  • Produce, personalize, and fulfill products;

  • Arrange shipping and customs clearance;

  • Provide tracking and delivery notifications;

You can unsubscribe from promotional emails at any time. Unsubscribing does not stop necessary order, account, security, or policy communications.

Legal and Business Purposes

We may use personal information to:

  • Comply with tax, accounting, customs, product-safety, consumer-protection, privacy, and other legal requirements;

  • Respond to lawful requests from courts, regulators, or government authorities;

  • Establish, exercise, or defend legal claims;

  • Enforce our policies and agreements;

  • Maintain business and transaction records; and

  • Evaluate or complete a merger, acquisition, financing, reorganization, sale, or similar business transaction.

5. Legal Bases for Processing

Where the laws of the European Economic Area, United Kingdom, Brazil, or another jurisdiction require a legal basis, Seventus relies on one or more of the following:

  • Performance of a contract, including processing purchases, personalization, payments, fulfillment, delivery, customer accounts, returns, and support;

  • Compliance with legal obligations, including tax, accounting, customs, fraud-prevention, product-safety, and consumer-protection requirements;

  • Legitimate interests, including operating and improving the store, protecting the Services, preventing fraud, communicating with customers, and establishing or defending legal claims, provided those interests are not overridden by your rights;

  • Consent, including for certain marketing communications, nonessential cookies, and targeted advertising where consent is required; and

  • Other legal bases permitted by applicable law.

Where we rely on consent, you may withdraw it at any time. Withdrawal does not affect processing that was lawful before the withdrawal.

6. Cookies and Similar Technologies

Seventus, Shopify, and certain service providers use cookies, pixels, tags, software development kits, local storage, and similar technologies to:

  • Operate essential store and checkout functions;

  • Keep customer accounts secure;

  • Remember cart contents and preferences;

  • Analyze traffic and store performance;

  • Prevent fraud;

  • Measure marketing performance; and

  • Personalize content or advertising.

Where required, we will request consent before using nonessential cookies. You may manage available choices through our cookie banner or other privacy controls.

Blocking certain cookies may prevent some store, checkout, account, or personalization features from working correctly.

7. Targeted Advertising and Your Privacy Choices

Seventus does not sell personal information in exchange for money.

However, the disclosure of identifiers, device information, usage information, commercial information, or inferred interests to advertising and analytics partners may be considered a “sale,” “sharing,” or use for “targeted advertising” under certain U.S. state privacy laws.

If you use a legally recognized Global Privacy Control or other required opt-out preference signal, Shopify and Seventus will process it as an opt-out request for the applicable browser or device in jurisdictions where recognition is required. If the signal can be associated with your Shopify customer account, the choice may also be applied to that account.

Other browser “Do Not Track” signals may not be recognized because there is no consistent industry standard governing them.

8. How We Disclose Personal Information

We may disclose personal information to the following categories of recipients when reasonably necessary.

Shopify

Shopify hosts the store and provides ecommerce, checkout, customer-account, security, analytics, personalization, and other platform services.

Payment Providers

Payment processors, banks, card networks, digital-wallet providers, and fraud-screening services process transactions and help detect unauthorized activity.

Production and Fulfillment Partners

Because Seventus products are made to order, we disclose the information needed to produce and fulfill an order to the responsible production partner. This may include:

  • Recipient and shipping information;

  • Product and variant information;

  • Personalization content;

  • Order identifiers; and

  • Claim photographs, videos, or other evidence when needed to investigate a production problem.

Production partners receive only the information reasonably necessary for their role.

Carriers, Logistics Providers, and Customs Authorities

We may disclose recipient names, addresses, telephone numbers, order details, identification or tax information, and customs information to carriers, logistics companies, customs intermediaries, postal services, and government authorities as needed for shipment and delivery.

Technology and Business Service Providers

We may disclose information to providers of:

  • Website hosting and infrastructure;

  • Customer accounts;

  • Live Chat and customer support;

  • Email delivery;

  • Cloud storage;

  • Security and fraud prevention;

  • Analytics;

  • Accounting and tax services; and

  • Other business technology.

Marketing and Advertising Partners

Where permitted, we may disclose device, usage, commercial, cookie, and related information to analytics, marketing, social-media, and advertising partners.

These disclosures may support measurement, personalization, retargeting, or targeted advertising. Available opt-out rights are described in Section 7.

Professional Advisers and Authorities

We may disclose information to attorneys, accountants, insurers, auditors, financial institutions, regulators, law-enforcement agencies, courts, or government authorities when reasonably necessary or legally required.

Business Transactions

Personal information may be disclosed or transferred in connection with a proposed or completed merger, financing, acquisition, reorganization, bankruptcy, asset sale, or transfer of all or part of the business.

At Your Direction

We may disclose information when you request, direct, authorize, or consent to the disclosure.

9. Relationship With Shopify

Shopify collects and processes personal information about your use of the Services to provide the ecommerce platform and related consumer services.

Certain Shopify features may use information from your interaction with Seventus, Shopify, and other Shopify merchants to improve security, analytics, personalization, advertising, or other enhanced services. For some of these activities, Shopify may act as an independent controller responsible for its own processing.

10. International Data Transfers

Seventus is based in the United States. Shopify, production partners, carriers, and other service providers operate in multiple countries.

Personal information may therefore be transferred to, stored in, or processed in countries other than the country where you live. Those countries may have privacy laws that differ from those in your jurisdiction.

Where required, international transfers will be supported by recognized legal safeguards, which may include:

  • An adequacy decision;

  • The European Commission’s Standard Contractual Clauses;

  • The United Kingdom’s approved transfer mechanisms;

  • Brazil’s approved international-transfer mechanisms; or

  • Another safeguard permitted by applicable law.

11. Data Retention

We retain personal information only for as long as reasonably necessary for the purposes described in this policy, including to:

  • Fulfill orders and maintain customer accounts;

  • Provide support and resolve claims;

  • Maintain tax, accounting, transaction, and customs records;

  • Prevent fraud and protect the Services;

  • Resolve disputes;

  • Enforce agreements; and

  • Comply with legal requirements.

The retention period depends on the type of information and why it was collected. For example:

  • Order and transaction records may be kept for several years to satisfy tax, accounting, consumer-protection, and legal requirements;

  • Customer-account information may be retained while the account remains active and for an appropriate period afterward;

  • Claims evidence may be retained until the claim, appeal, accounting, and related legal periods have ended;

  • Marketing information may be retained until you unsubscribe or object, subject to maintaining a suppression record so that we honor your choice; and

  • Cookie and analytics information is retained according to the applicable tool and privacy settings.

When information is no longer needed, we will delete, anonymize, or securely dispose of it, subject to legal exceptions.

12. Security

We use reasonable administrative, technical, and organizational safeguards designed to protect personal information.

No transmission or storage system is completely secure, and we cannot guarantee absolute security. Do not send full payment-card numbers, account passwords, or unnecessary identification documents through ordinary email or Live Chat.

If you have a customer account, you are responsible for protecting access to your email account and any authentication method used to sign in.

13. Children’s Privacy

The Services are not directed to children under 13, and Seventus does not knowingly collect personal information from children under 13.

The Services are also not intended to be used to enter a purchase contract by anyone who lacks legal capacity to do so without the authorization of a parent or guardian.

Seventus does not have actual knowledge that it sells or shares, as those terms are defined by applicable law, personal information belonging to individuals under 16.

If you believe a child has provided personal information to Seventus, contact us so that we can review and, where appropriate, delete it.

14. Your Privacy Rights

Depending on where you live and subject to applicable exceptions, you may have the right to:

  • Confirm whether we process your personal information;

  • Access or obtain a copy of your personal information;

  • Correct inaccurate or incomplete information;

  • Request deletion of certain information;

  • Request restriction, anonymization, or blocking of certain processing;

  • Receive certain information in a portable format;

  • Object to particular processing;

  • Opt out of sale, sharing, targeted advertising, or certain profiling;

  • Limit certain uses of sensitive personal information;

  • Withdraw consent;

  • Request information about the categories of recipients that receive your information;

  • Request review of certain automated decisions;

  • Appeal a decision concerning a privacy request; and

  • Lodge a complaint with an applicable regulator.

These rights are not absolute. We may deny or limit a request when permitted by law, such as when information must be retained for tax, fraud-prevention, transaction, security, legal-claim, or other lawful purposes.

You may object to or opt out of direct marketing at any time. Use the unsubscribe link in a marketing email or contact Seventus.

We will not unlawfully discriminate against you for exercising an applicable privacy right.

15. Additional Information for Certain U.S. Residents

During the preceding 12 months, Seventus may have collected the categories of personal information described in Section 2 from the sources described in Section 3.

We may have disclosed those categories for the business purposes described in Sections 4 and 8.

For targeted advertising, we may have shared the following categories with advertising or analytics partners:

  • Contact or online identifiers;

  • Device and network information;

  • Usage and interaction information;

  • Commercial or transaction-related interests; and

  • Inferences concerning likely product interests.

We do not use destination-specific national identification or tax numbers to infer characteristics or deliver targeted advertising.

Residents of states with applicable comprehensive privacy laws may have rights to access, correct, delete, obtain, or opt out of certain processing. They may also have a right to use an authorized agent or appeal the denial of a request.

16. Additional Information for the EEA and United Kingdom

If you are located in the European Economic Area or United Kingdom, you may have rights to:

Seventus does not intend to make decisions that produce legal or similarly significant effects about you solely through automated processing. Automated tools may assist with fraud detection, security, product recommendations, or advertising, but material decisions will be reviewed where required by law.

17. Additional Information for Brazil

If the Brazilian General Data Protection Law applies, you may have rights to:

  • Confirm that processing exists;

  • Access your personal data;

  • Correct incomplete, inaccurate, or outdated data;

  • Request anonymization, blocking, or deletion of unnecessary, excessive, or unlawfully processed data;

  • Request portability where applicable;

  • Obtain information about entities with which data was shared;

  • Withdraw consent;

  • Request deletion of data processed based on consent, subject to lawful retention;

  • Request information about the consequences of refusing consent; and

  • Request review of certain decisions made solely through automated processing.

You should first submit your request to Seventus using the contact information below. If the matter is not resolved, you may have the right to submit a petition to Brazil’s National Data Protection Authority.

18. Exercising Your Rights

Verification may require confirming control of the email address associated with the order or account and providing information about a recent transaction. Do not send an identification document unless we specifically request it and provide appropriate instructions.

Where permitted, an authorized agent may submit a request for you. We may require evidence of the agent’s authority and may also verify your identity directly.

We will respond within the period required by applicable law. If we deny a request, we will provide an explanation and appeal instructions when required.

Requests concerning processing controlled independently by Shopify may also be submitted through the Shopify Privacy Portal.

If you have a concern about how Seventus processes personal information, contact us first so that we can review it.

Depending on where you live, you may also have the right to complain to a state attorney general, privacy authority, data-protection authority, consumer-protection authority, or other regulator.

20. Third-Party Websites and Services

The Services may link to third-party websites, social-media platforms, payment services, or other services not controlled by Seventus.

This Privacy Policy does not govern the privacy practices of those independent parties. Review their privacy notices before providing personal information. A link from Seventus does not, by itself, mean that we endorse or control the third party’s privacy or security practices.

21. Changes to This Privacy Policy

We may update this Privacy Policy to reflect changes in our Services, providers, technology, legal obligations, or business practices.

When we make changes, we will post the revised policy and update the “Last updated” date. We will provide additional notice when required by law.
